PRÉAMBULe:
Les présentes conditions sont conclues entre, d'une part, la société SATNAM SASU, dont le nom commercial est MONOKI by Diane Goldstein, ci-après dénommée « MONOKI by Diane Goldstein», numéro d'identifiant unique : RCS PARIS 823 154 471 et d'autre part, les personnes souhaitant effectuer un achat via le site internet de MONOKI by Diane Goldstein (www.monoki.fr) ,ci-après dénommée « l'utilisateur ». Ces conditions ne concernent à titre exclusif que les personnes physiques non commerçantes. Les parties conviennent que leurs relations seront régies exclusivement par le présent contrat, à l'exclusion de toute condition préalablement disponible sur le site. Si une condition venait à faire défaut, elle serait considérée être régie par les usages en vigueur dans le secteur de la vente à distance dont les sociétés ont le siège en France.
1. OBJET
Les présentes conditions visent à définir les modalités de vente entre MONOKI by Diane Goldstein et l'utilisateur, de la commande aux services, en passant par le paiement et la livraison. Elles règlent toutes les étapes nécessaires à la passation de la commande et assurent le suivi de cette commande entre les parties contractantes.
2. COMMANDE
Toute commande vaut acceptation des prix et description des produits disponibles à la vente ainsi que des conditions générales de vente. Toute contestation sur ce point interviendra dans le cadre d'un éventuel échange et des garanties ci-dessous mentionnées.
MONOKI by Diane Goldstein s'engage à honorer les commandes reçues sur le site internet uniquement dans la limite des stocks disponibles des produits. A défaut de disponibilité du produit, MONOKI by Diane Goldstein s'engage à en informer l'utilisateur.
3. FRAIS DE PORT ET LIVRAISON
Les frais de port seront précisés au client lors de la confirmation de la commande.
Les produits commandés seront livrés à l'adresse indiquée par l'utilisateur partout dans le monde.
Les commandes passées avant 12h00 sont préparées et expédiées le jour même du passage de la commande. Les commandes passées après 12h00 seront expédiées le lendemain.
Les délais de livraison courent à partir de cette date. Ils seront, dans la limite des stocks disponibles de 7 jours ouvrés maximum pour la France et de 9 jours ouvrés pour l'étranger selon la destination et le mode de livraison choisi.
En cas de retard, la responsabilité de MONOKI by Diane Goldstein ne pourra être engagée et ce, pour quelque cause que ce soit. Par conséquent, aucune demande d'indemnisation, de quelque nature que ce soit, ne pourra être réclamée par l'utilisateur à MONOKI by Diane Goldstein.
Note : Pour toute livraison en dehors de l'Union Européenne, des frais de douane et taxes supplémentaires peuvent être appliquées et sont à la charge du client.
4. TARIFS, PAIEMENT ET FACTURATION
Les prix sont indiqués en euros toutes taxes comprises. Les prix ne pourront être modifiés une fois la commande du client passée. De même, si une ou plusieurs taxes ou contributions venaient à être crées ou modifiés, en hausse comme en baisse, ce changement pourra être répercuté sur le prix de vente des articles présents sur le site de MONOKI by Diane Goldstein.
Les prix indiqués sur le site sont garantis pour la durée de mise en ligne et dans la limite des stocks disponibles.
Le prix définitif facturé au client est le prix indiqué sur la confirmation de commande.
Le paiement s'effectue par carte bancaire portant le sigle Visa, Eurocard, Mastercard ou American Express. Vous pouvez également payer via PayPal. Votre compte bancaire sera débité à validation de votre commande. Sachant qu'il y a toujours un délai de la part des banques, la validation de paiement peut parfois prendre un jour, à compter de la validation de la commande. La facture du produit sera insérée dans le colis contenant le produit commandé.
5. DROIT DE RÉTRACTATION, RETOURS ET ÉCHANGES
Tous les articles de la collection en cours peuvent faire l'objet d'échange (en fonction du stock). Les articles personnalisés ou produits exclusivement à la demande ne peuvent être échangés ou remboursés.
Les retours clients peuvent être effectués par voie postale à l'adresse indiquée ci-dessous dans un délais de quatorze jours ouvrables à compter de la date de réception ou de retrait du colis. Les produits doivent être renvoyés par voie postale en parfait état à l'adresse suivante :

Il appartient à l'utilisateur de conserver toute preuve et date de ce retour. Les remboursements se feront dans les 10 jours ouvrés suivant la réception du colis.
Attention, pour les retours hors UE, nous vous invitons à bien préciser sur le formulaire des douanes qu'il s'agit d'un « retour » de telle sorte à obtenir un retour en « affranchissement de droits et taxes » (sans frais supplémentaires).
6. GARANTIES ET LITIGES
Tous les articles sont soumis à une garantie contractuelle, laquelle ne fait pas obstacle à la garantie légale prévue par les articles 1641 et suivants du Code civil. L'utilisateur bénéficie en outre d'une garantie lui permettant de renvoyer les articles livrés défectueux conformément aux articles L 211-4 et suivants du code de la consommation. L'utilisateur est donc invité à se reporter à ses textes s'il désire avoir plus de précision sur ces garanties légales.
Tous les litiges concernant une vente conclue en application des conditions générales de vente pourraient - concernant tant leur validité, leur interprétation, leur exécution, leur résiliation, leurs conséquences, leurs suites et qui n'auraient pu être résolues entre le vendeur et le client - être soumis aux tribunaux compétents dans les conditions de droit commun.
7. SIGNATURE ET PREUVE
Dans tous les cas, la fourniture en ligne du numéro de carte bancaire et la validation finale de la commande vaudront preuve de l'intégralité de ladite commande conformément aux dispositions de la loi du 13 mars 2000 et vaudront exigibilité des sommes engagées par la saisie des articles figurant sur le bon de commande.
Cette validation vaut signature et acceptation expresse de toutes les opérations effectuées sur le site. Toutefois en cas d'utilisation frauduleuse de sa carte bancaire, le client est invité, dès le constat de cette utilisation à contacter MONOKI by Diane Goldstein en envoyant un mail à info@monoki.fr.
MONOKI by Diane Goldstein s'engage à décrire avec la plus grande exactitude les produits vendus sur le site internet de MONOKI by Diane Goldstein. En revanche, la responsabilité de MONOKI by Diane Goldstein ne pourrait être engagée dans le cas où l'inexécution de ses obligations serait imputable soit au fait imprévisible et insurmontable d'un tiers au contrat soit à un cas de force majeure telle que définie par la Jurisprudence française. 4. RATES, PAYMENT AND BILLING :
Prices are quoted in euros all taxes included. They take into account the French VAT applicable on the day of the order. These prices don't include the cost of processing (shipping and packaging). Any change of applicable rate can be repercuted in the prices of products.. After this date, they are subject to change at any time. However prices cannot be changed once the customer's order has been placed. Similarly, if one or more taxes or contributions were to be created or modified, upwards or downwards, this change could be reflected in the selling price of the items on the MONOKI by Diane Goldstein website.
The prices listed on the website are guaranteed as long the product is online and within the limits of available stocks.
The final price charged to the customer is the price indicated on the order confirmation page.

5. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE :
All items of the current collection may be subject of an exchange (depending on the stock). The request for exchange by the user must take place within fourteen working days from the date of receipt or withdrawal of the package. Customized items or special orders on demande cannot be exchanged or refunded.Return costs are to be paid by the user. The user is obligated to keep all proof and date of his return. If the user wishes an exchange, the new delivery charges will not be charged to the user.
Refunds will be made within 10 working days of receipt of the package.
6. GUARANTEES AND DISPUTE:
All items are subject to a contractual warranty, which doesn't preclude to the legal guarantee provided by articles 1641 and following of the Civil Code. The user also benefits of a guarantee allowing him to return defective items delivered in accordance with Articles L 211-4 and following of the Consumer Code. The user is therefore invited to refer to his texts if he wishes have more precision on these legal warranties.
All disputes regarding a transaction concluded in application of these general terms and conditions of sale could be - concerning their validity, interpretation, execution, termination, consequences and which could not have been resolved between the seller and the customer - submitted to the competent courts under the conditions of common law.
7. SIGNATURE AND PROOF :
In any case, the credit card number procured online and the order final confirmation shall constitute the evidence of said order in accordance with the provisions of the French Law of March 13th, 2000 and will cause the sum incurred for the order to become due and payable. This validation is worth signature and express acceptance of all the operations made on the site.
